Terms and Conditions
1. Introduction
These terms and conditions govern the services provided by VISUALISE. By engaging with our services, you agree to comply with these terms.
2. General Terms
The services provided by VISUALISE will include only what is listed in the project proposal or proforma invoice.
This may or may not include 3D modeling, depending on what was specified in the agreed quote or proforma.
Any additional work outside the initial agreement will require written approval and may incur extra charges.
3. Payment Terms
Payments must be made on or before the agreed due date as stated in the invoice or proforma.
If payments are not made by the due date:
VISUALISE will stop working on the project.
For projects in the final phase, final files will not be delivered.
For long-term projects with milestones, work will be paused until payment is received.
Any delays caused by non-payment will affect the project timeline. VISUALISE is not responsible for these delays.
Clients must cover all payment fees so VISUALISE receives the exact agreed amount.
4. Timelines and Delays
VISUALISE is committed to meeting the agreed deadlines.
Delays caused by unforeseen circumstances (e.g., natural disasters, technical failures) are beyond VISUALISE’s control and will be communicated promptly.
If there are delays from the client in providing information, feedback, or other necessary inputs, VISUALISE has the right to adjust the timeline accordingly and set a new deadline.
5. Revisions
All of our services include up to 2 rounds of revisions. These revisions cover updates within 30% of the initial scope of work. Additional rounds will be charged separately.
6. 3D Modeling
If 3D modeling is required and mentioned in the proforma invoice, it refers to modeling the architectural scope and spaces of the project. This does not include modeling furniture, objects, or decorative elements. VISUALISE does not model furniture or standalone objects.
VISUALISE uses 3D models from its own library or freely available online models. If the client needs a specific piece of furniture, object, or element, and it is available in the mentioned libraries, VISUALISE will incorporate it into the project. Otherwise, VISUALISE will use a similar 3D model. If the exact model is required, the client must provide it.
7. File Delivery and Formats
Final deliverables for still images will be provided in high-resolution JPEG, PNG, or PDF formats, as specified in the initial agreement. Standard resolutions are 3000 pixels or 4000 pixels.
If source files (like 3D models), post-production files, etc., are required:
VISUALISE has the right to decline sending these files.
If agreed to send them, additional charges may apply.
Animations will be delivered in (mp4) format. If other formats are needed, they must be decided before the project starts.
360 virtual tours can be delivered in (HTML file), (ggpkg file), and (embed code). If the client needs an embed code or a direct link to preview the virtual tour, additional charges will apply due to hosting costs.
VISUALISE hosts 360 virtual tours for up to 6 months. If the client wants to extend the hosting period, a request must be sent, and additional charges will apply.
VISUALISE 360 tours do not fully support VR headsets and have limited customization options.
8. Intellectual Property and Usage Rights
Upon full payment, all rights to the final renderings will transfer to the client.
VISUALISE retains the right to use the images in its portfolio, on its website, and in marketing materials unless the client specifies otherwise in writing.
If the client requests confidentiality or a specific date for the use of the images, VISUALISE will respect that.
9. Confidentiality
VISUALISE will maintain the confidentiality of all client-provided materials and project details unless otherwise agreed upon.
If confidentiality is required, the client must provide written notice.
10. Liability and Indemnification
The client is responsible for any use or distribution of the renderings and must ensure that all materials they provide are free from third-party claims.
VISUALISE is not responsible for issues arising from unauthorized use or intellectual property disputes linked to client-provided materials.
11. Termination and Refunds
Either party may terminate this agreement with written notice.
If the client terminates the project:
The initial 50% deposit is non-refundable.
For projects with milestones, payments made are non-refundable.
If VISUALISE terminates the project, a pro-rata refund will be calculated based on the work completed.
12. Modifications and Updates
VISUALISE reserves the right to update these terms at any time. Changes will be posted on this page.
13. Agreement
By using VISUALISE’s services, you agree to these terms and conditions.
